An activist’s challenge to unequal treatment

Dausab filed the case in June 2022, and it was heard in October 2023. Human Dignity Trust supported his legal team, while Positive Vibes also backed the case. After the ruling, Dausab said the offences had obstructed an open life and access to HIV prevention and treatment. He welcomed the possibility of living without being treated as a criminal.

The court rejects prejudice as a justification

Human Rights Watch reported that the court rejected differential treatment of gay men and the use of a community’s private moral views to restrict other people’s freedoms. Researcher Larissa Kojoué welcomed the ruling on 25 June while warning about a hostile political environment. Her response connected legal equality with protection from discrimination and violence.

Dausab warns that the victory remains contested

In a personal account published on 23 June 2026, Dausab said the government had appealed and that he was still awaiting a Supreme Court hearing date. “My journey to freedom is far from over,” he wrote. He called for continued support for the legal challenge and for equality to be reflected in political decisions as well as court judgments. [3]
