Law 27.793 declared a national disability emergency until 31 December 2026, with a possible one-year extension. It provided for a new non-contributory disability pension, measures to sustain service providers and automatic monthly adjustments to service payments. Congress confirmed the legislation after the presidential veto, as recorded on 4 September 2025. [2]

The organisation disputes the funding argument

In a court submission signed by lawyer María Celeste Fernandez, ACIJ argued that suspension lacked constitutional and legal grounds. It said Congress had already authorised budget reallocations for implementation. The executive had justified suspension by referring to the need for funding sources and budget appropriations; these were opposing positions in litigation. [3][1]

Regulations follow a court order

Decree 84/2026, published on 4 February 2026, approved implementing regulations. It recorded that the Campana federal court had ordered immediate application on 12 December 2025 and that the government had appealed. The decree introduced administrative rules, while expressly maintaining the government’s disagreement with the judgment. [4]
