Rights and participation enter the wording
The new article states that people with disabilities exercise constitutional rights in conditions of real and effective freedom and equality. It also requires public bodies to encourage the participation of their representative organisations. Women and children with disabilities receive express attention because of their particular needs. [1]
The change followed sustained advocacy
The amendment’s preamble recognises the role of organised civil society in demanding reform. In a 2024 contribution to the disability-law journal published by CERMI, researcher Beatriz de Miguel Vijandi traced the long political process and the disability movement’s demands. Her analysis describes both changes in language and the move towards a rights-based constitutional approach. [1]
Publication completed the constitutional procedure
The parliamentary record documents the reform’s passage and links to the final gazette text. The amendment was dated 15 February and took effect on publication two days later. [3][1]
